What Documents Will You Need?

  1. Application Form: Downloadable from the Italian Consulate’s website, fully completed and signed by the person requesting the registration.

  3. Divorce Decree (“Decree Absolute”): Provide the original document along with a complete Italian translation. The translation must include the judge’s certification: “I certify that this is a true copy of an original document filed with this Court.”
  4. Agreement for Children: If there are minor children, include the Agreement for Children with its Italian translation and the above-mentioned judge’s “true copy” stamp.
  5. Form Art. 39 – Form D180: This must be completed, dated, signed, and stamped by the court.
  6. Submission: Send all the documents via Special Delivery to the address of the Consulate General of Italy.

Important Notes for British Divorce Decrees

  • For decrees issued before March 2001 or after January 1, 2021 (post-Brexit):
    You must also submit the provisional decree (“Decree Nisi”) in the original, with an Italian translation and the judge’s “true copy” certification.
  • For decrees issued between March 2001 and January 1, 2021:
    The Art. 39 – Form D180 can replace the provisional decree (“Decree Nisi”). Note, however, that Art. 39 is no longer valid post-Brexit.

Legalization Requirements

Unlike other documents sent to an Italian consulate in the UK, the aforementioned documents do not require Apostille legalization. A judge’s stamp will suffice.

Additional Information

  • If the documentation is deemed complete and correct, the original certificates will not be returned.
  • If the documentation is incomplete or incorrect, the application will not be processed, and the documents will only be returned if you include a prepaid (Special Delivery) envelope with your submission.
