Translating the Italian Criminal Record Certificate for British Citizenship: Complete 2026 Guide

Among the documents required for a British naturalisation application, the criminal record certificate is the one that generates the most questions — and the most anxiety. Which version should you request? Does it need an apostille? What happens if it is not entirely clean? In this guide we answer everything.

Why the Home Office Requires a Criminal Record Certificate

One of the fundamental requirements for British naturalisation is demonstrating ‘good character’. The Home Office assesses this by examining the applicant’s criminal history, both in the UK and abroad. For Italian citizens residing in the UK, the required document is the Certificato del Casellario Giudiziale issued by the Italian Ministry of Justice.

This applies to all naturalisation routes: standard (Section 6(1)), as the spouse of a British citizen (Section 6(2)), or through extended residence.

Which Document to Request: Not All Certificates Are Equal

There are several types of certificates issued by the Italian Casellario Giudiziale, and not all are suitable for UK immigration applications. Here are the differences:

Certificato del Casellario Giudiziale (for use abroad or general administrative use)

This is the correct document for British naturalisation applications. It lists all final criminal disposals recorded against the applicant in the Casellario Giudiziale register. This is the document to request.

Certificato dei Carichi Pendenti (Pending Charges Certificate)

This lists ongoing criminal proceedings not yet concluded with a final sentence. It is not a substitute for the Casellario Giudiziale certificate — in some cases it may be requested in addition, but not on its own.

Certificato per Uso Privato (Private Use Certificate)

This contains partial information and is not suitable for official or international use. Avoid for UKVI applications.

TIP: When requesting the certificate, explicitly specify ‘uso estero’ (for use abroad) or ‘uso amministrativo generale’ (general administrative use). This ensures the most complete version of the document is issued.

How to Request the Casellario Giudiziale Certificate

The certificate can be requested in several ways:

  • Online via the Ministry of Justice portal (giustizia.it) — the fastest method
  • In person at any Casellario Giudiziale office in Italy
  • Through a delegate with a power of attorney, if you are not in Italy
  • Through the Italian Consulate in some cases — though timescales are longer

Issue is generally free of charge for personal use. The document is usually released within a few working days via the online portal.

Does It Need to Be Recent? The Question of Temporal Validity

Yes. The Home Office requires the criminal record certificate to be recent at the time of submitting the application. Established practice is that the document should be no more than 6 months old at the time of submitting the naturalisation application.

Plan your timing accordingly: do not request the certificate too far in advance of submitting your application, or it may be considered expired and you will need to request a new one.

Does It Need an Apostille?

For UKVI applications and the Home Office, an apostille on the original document is not required. An apostille is required when the document needs to be used for Italian consular applications or in other countries that require it — but not for a British naturalisation application.

What is mandatory, however, is the certified English translation.

What the Translation Must Contain for the Home Office

The translation of the Casellario Giudiziale for the Home Office must comply with all standard UKVI requirements:

  • Full translation of the document, including stamps, headings, codes and any annotations present
  • Signed declaration from the translator confirming their competence and the accuracy of the translation
  • Translator’s full name, contact details and date

Notarisation is not required. Court certification is not required. The translation can be delivered in digital format for most online applications.

IMPORTANT: Even apparently ’empty’ fields or phrases such as ‘no record’, ‘no entries’ or ‘no disposals registered’ must be translated. A translation that omits these sections may be rejected by the Home Office.

What Happens If the Record Is Not Clean

Having a criminal record does not automatically mean the naturalisation application will be refused. The Home Office assesses the nature of the offence, its severity, the time elapsed and subsequent behaviour. Some types of conviction lead to automatic refusal (for example, sentences of more than 4 years’ imprisonment), while others are assessed on a case-by-case basis.

The most important thing is to declare everything accurately on Form AN. Omitting or misrepresenting information about your criminal history is a certain cause for refusal — and can have legal consequences. If you have a criminal record, whether in Italy, the UK or elsewhere, consult an immigration lawyer before submitting your application.

Do I Need to Submit Criminal Records from Other Countries?

Yes, if you have lived in other countries for 12 months or more in the last 10 years (or over the relevant period for the application), the Home Office may also require criminal record certificates from those countries. This is particularly relevant for those who lived in Italy, Brazil, the USA or other countries before moving to the UK.

These documents must also be translated into English with a certified translation.
