New Italian Legislation on Birth Registration Abroad

Extension of the Deadline to Three Years and Grace Period Until May 2026

Italy has recently introduced an important amendment to its civil-status legislation concerning the registration of births abroad. Under the new provisions, Italian citizens now have up to three years from the date of birth to register a child born overseas, replacing the previous one-year deadline.

This change is particularly relevant for Italian citizens resident abroad who must submit birth registrations through the competent Italian Consulate. It is also essential to note that a transitional grace period remains in force until May 2026.

Under the previous legal framework, the birth of a child born abroad to an Italian citizen had to be registered within one year. In practice, this deadline was often difficult to meet due to the time required to obtain foreign civil-status documents, apostilles, certified translations, and consular appointments.

The new legislation extends the registration period to three years from the date of birth.

Transitional Grace Period Until May

Despite the introduction of the three-year deadline, a grace period remains applicable until 26 May for cases that were subject to the previous one-year requirement.

The updated provisions apply to children born abroad to at least one Italian citizen and registrations submitted via an Italian Consulate or Comune.
